Your statement on behalf of the group of legal entities received together with the request of Deputy Chairman of the State Duma Federal Assembly of the Russian Federation Vladimir Zhirinovsky, on the decision to refuse KM DAEC ATC Central District of St. Petersburg on the refusal to the criminal case against the leaders of LLC "Childhood" in the General Prosecutor of the Russian Federation was considered.

In part, the applicants have fulfilled their obligations under contracts to the company LLC «Childhood», but, to date, payment for the goods is not received from the company LLC «Childhood».

On this occasion You submitted application in the police Department of St.-Petersburg and Leningrad region, as well as to the Prosecutor's office of St. Petersburg. The police of St. Petersburg and the Leningrad region requested an inspection on this appeal to the police of the Central district of St. Petersburg, where 10.07.07 about this occasion, was registered the material KUSP № 21409.

The prosecutor's office of the city also sent a similar appeal for oversight of the prosecutor's office area, what you duly notified.

ESTABLISHED:

In KM DAEC Police Central District of St. Petersburg RECEIVED collective statement from representatives, into the possible illegal actions by Mikhail Mikhailovich Kirilenko of the CEO of LLC «Childhood».

During the checking, it was found, between the leadership of JSC «Lipetskkhlebmacaronprom», JSC « ATK Torgavto», LLC «Prado», JSC «ATGP-44». Ltd «Don», PE «Symonenko V. I.» PE «Kemerov», JSC «St. Petersburg dairy factory № 1 PETMOL». LLC «Piterfut», LLC «Pomost» and LLC «Childhood» represented by its General Director Mikhail Mikhailovich Kirilenko, have signed contracts for the supply of products under the terms of the contract, and then in the address of LLC «Childhood» located at: SPb, Chernjahovskogo Str., 17 and Transportnyj pereulok, 10 ordered items were supplied. After that, this products has not been paid. All attempts to contact with M. Kirilenko were unsuccessful, at the workplace citizen Kirilenko does not appear, the calls on mobile phone is not answered. В связи с тем, due to the fact that it is not possible to contact Kirilenko, the leadership of these organizations, it was decided to apply to the Ministry of Internal Affairs.

Currently, there is no reason to believe, that the actions of citizen M. Kirilenko not due to force majeure, independent of М. Kirelenko. Due to the fact that statutory deadlines it was not possible to interrogate of the citizen Kirilenko and the citizen Vavilenko, it is impossible to establish the existence of signs of corpus delicti in their actions.

Based on the above, guided by Part 1 of Article 24, paragraph 2 of Articles 144, 145 and 148 Code of Criminal Procedure of Russian Federation,

RESOLVED:

1. To refuse to Institute criminal proceedings against the citizen M. Kirelenko
2. The copies of the decision not to institute criminal proceedings to send to the Prosecutor of the Central district of St. Petersburg and to the applicant, explaining the applicant that this decision may be appealed to the prosecutor or the court, in the order of Articles 124 and 125 of the Code of Criminal Procedure of Russian Federation;
3. Upon receipt of the requested information, indicating the presence of a crime to solve the question of the abolition of this decision, additional verification, and the adoption of the legal procedural decision.
