STATEMENT

More than 60 major companies supplying the food products, including the agricultural producers from the city of St. Petersburg and other regions on the basis of the deliveries in 2005-2006 as a result of fraud have lost more than 30 million rubles.

The persons responsible for this fraud was the management of LLC "Food Company" Detstvo" from the city of St. Petersburg, which served the government-financed organizations of St. Petersburg in these years. The government has fully paid off with LLC «FC Detstvo" ("Childhood") for the deliveries of 2006, but they have not returned the debts to the suppliers, and have appropriated the money for themselves.

The injured creditors, including the public corporation "Pekar", the close corporation "Petmol" Trade. North" and the close corporation "Thaelmann Plemhoz" properly, to protect their interests, were in the courts of arbitration, instituted the executory process. Simultaneously, in pursuance of paragraph 1.2 of Art. 24 of the code of criminal procedure of Russian Federation, applied to the public prosecutor's office and the Economic Crime Department of Internal Affairs of Central District in St. Petersburg, and then to the St. Petersburg prosecutor with the requirements of institution of a criminal case and institution of criminal proceedings against Kirilenko M.M. and Vavilenko L.V.

Result.

The Economic Crime Department of Internal Affairs of Central District of central district has for nearly a year carried out an investigation. A criminal case has not yet been instituted (????). One of the suspects Kirilenko M.M. (obviously has the strong protectors) is supposedly hiding (??). His investigation has not even been announced. (?) There is no doubt that the staff of the Economic Crime Department of Internal Affairs and the public prosecutor's office of central district in St. Peterburg, with the tacit agreement of the public prosecutor's office of St. Peterburg probably do not intentionally bring a lawsuit for almost a year and in spite of numerous statements do not institute criminal proceedings against the executives of LLC "Food Company "Detstvo". The Smolnensky department of bailiff service (the Federal Bailiff Service Directorate of the Сity of St. Petersburg) passed a resolution a year ago to initiate the executory process. Kirilenko M.M and Vavilenko L.V. were only 800 meters from the bailiff service almost 7 months. The comment! Beginning in March and April 2007, all suppliers of public sector go with complaints on the administrations of St. Petersburg, the arbitration courts, bailiffs, law enforcement authorities. None of the authorities did not take any measures, and continues to send money in the Company "Food Company Detstvo" ("Childhood") and "Trade House Raduga" ("Rainbow"). And as a result, continue to lost money and products (goods) in the tens of millions of rubles. Does power «work hard» and develop a budget?! :)

Non-use of criminal law to the suspects Kirilenko M.M. and Vavilenko L.V. by the law enforcement bodies, bailiff service and prosecutors of central district and the city of St. Petersburg is in whole inexplicable. Omission to act of the above structures, that was expressed in the not involvement to fraudulent activities of the above-mentioned suspected in 2005-06 helped the suspect to commit a series of another fraudulent activities.

Having created another commercial structure of LLC "Trade House Raduga" and won a tender in 2007 (???), the suspects committed another activities, the responsibility for their commission is provided for the appropriate articles of the Criminal Code. As a result, another group of the deceived suppliers appeared in 2007, and again the above-mentioned suspects Kirilenko M.M. and Vavilenko L.V. embezzled millions of rubles. For example:

- one of the victims, an applicant LLC "Artis - baby food" bore losses amounting to 6.3 million rubles in 2007.

The group of victims on the basis of the above-stated and in accordance with paragraph 1.2 article. 21 of the code of criminal procedure of Russian Federation:

1. To require from the Law enforcement authorities and prosecutor of Central District of St. Petersburg to fulfill its responsibility to ensure law and order and institute criminal proceedings against the management of LLC "Food Company "Detstvo" and LLC "Trading House Raduga " represented by Kirilenko M.M. and Vavilenko L.V. under Art. 159, 165 of the Criminal Code of Russian Federation "fraud", "property damage" and Art. 315 of the Criminal Code of Russian Federation "non-fulfilment of court decision".
2. To require to conduct an investigation upon cover-up of a crime in a large scale and to institute criminal proceedings against the guilty officials from law enforcement bodies, bailiff service and public prosecutor's office under Art. 293 of the Criminal Code of Russian Federation "Negligence."
3. To respond to the given period by the laws of Russian Federation.
